Commonwealth Dance Relay: Terms and Conditions
By submitting a recording (your “Submission”) via our Google Form, you confirm that you have read,
understood, and agree to these terms.
1. Who we and you are
“We”, “us” and “our” means The Commonwealth Resounds, a charity registered with the Charity Commission for
England and Wales with charity number 1160199, as a CIO at Companies House with number
CE0022843, and whose registered office is at 4 Index House, Midhurst Road, Liphook, Hampshire, GU30 TN.
“You” and “your” means the individual, organisation, or group detailed in any application form to join the
Commonwealth Dance Relay.
2. Permissions and safeguarding
- You confirm you have the permission of everyone who appears in your Submission to be filmed and for the Submission to be used as described below.
- If anyone featured in the Submission is under the age of 18, you confirm that a parent or legal guardian has given permission for them to take part in the film/video and for the Submission to be used as described below.
- You are responsible for ensuring your filming location is safe and that you have permission to film there if needed (for example, in schools, studios, or private venues).
3. The music
- The Commonwealth Dance Relay music (“CDRM”) is a score prepared especially for the Relay and the copyright in it belongs to The Commonwealth Resounds.
- You may use the CDRM and any CDRM track provided by us only for creating and submitting your Dance Relay recording, and for sharing your own recording in a way that relates directly to the Dance Relay itself.
- You must not use the CDRM for any other project, performance, publication, broadcast, or commercial purpose without our written permission. A fee may be payable.
- If you add any live instruments to the CDRM to play alongside or instead of it, you must not change the basic structure or harmony of the music, and you must only add material you have the right to use.
4. Ownership and rights in your Submission
In consideration of us accepting your Submission, you agree that, to the fullest extent permitted by law,
you assign (transfer) to The Commonwealth Resounds all rights, title, and interest in your Submission,
including copyright and related rights, with effect from the date of submission.
If, for any reason, this assignment is not effective in your jurisdiction, you grant The Commonwealth Resounds an
exclusive, perpetual, worldwide, royalty-free licence to use your Submission in any
media and format, including the right to sub-licence these rights to our partners and third parties.
5. How we may use, share, and adapt your Submission
You agree that The Commonwealth Resounds may, in connection with the Commonwealth Dance Relay and our wider activities:
- store, copy, reproduce, distribute, publish, broadcast, stream, and communicate your Submission to the public
- use your Submission in any media and format now known or later developed (including websites, social media, video platforms, press and broadcast, print, displays, events, reports, and archives)
- share your Submission with partners, including funders, supporters, sponsors, participating organisations, and delivery partners
- sub-licence the rights in your Submission to partners and third parties as part of the Relay, including media organisations (for example, broadcasters, publishers, and online media outlets)
- edit, crop, resize, add captions/subtitles, include logos, create extracts, and combine your Submission with other content, provided the overall content is not misleading
- use your Submission with or without credit. We will aim to give credit where practical, but cannot guarantee this in every context.
You understand that you will not receive any payment, fees, royalties, or other remuneration for your Submission,
and we do not need to notify you each time it is used.
6. Waiver of moral rights
To the fullest extent permitted by law, you waive any moral rights you may have in your Submission (including the right
to be identified as the author and the right to object to derogatory treatment), and you agree not to assert those rights
against The Commonwealth Resounds, our partners, or any party authorised by us.
7. Your promises (important)
You confirm that:
- the CDRM excepted, your Submission is your own original work and you have the right to submit it
- your Submission does not infringe anyone else’s rights (including copyright, performers’ rights, privacy, or trade marks)
- your Submission does not include any music other than the CDRM track (and any permitted live additions you have the right to add and use)
- you have obtained all necessary permissions from performers, choreographers, and anyone else who has rights in the performance
- your Submission does not contain anything unlawful, harmful, defamatory, or unsafe
8. Moderation and removal
We may refuse, remove, or stop using any Submission at any time (for example, where we have rights or safeguarding concerns).
We are not obliged to publish or use every Submission.
9. Privacy and data protection
Your Submission may include personal data (for example, identifiable faces, voices, names, or locations). By submitting, you agree
that we may process this personal data to run the Commonwealth Dance Relay, promote the Relay, document the project, and share it with
partners and media organisations as described above.
Please note: once a Submission has been shared or published (for example, on websites, social media, or through partner and
media channels), it may be copied, re-shared, or stored by others. This means that it may not be possible to remove your Submission completely
from all places, even if you later request removal.
